General Motors Seeks Court Protection Against Select Ignition Lawsuits

In what had to be the vaguest, wordiest press release ever, General Motors has announced that filed a motion in the Bankruptcy Court for the Southern District of New York to enforce a bar on lawsuits stemming from ignition defects in cars sold before its 2009 bankruptcy. The motion includes only lawsuits resulting in “economic damages,” and not that of injuries, loss of life or property damage. Meanwhile, plaintiffs are seeking an order declaring that GM cannot rightfully use the bankruptcy protection to absolve itself from liabilities.

While the court weighs in on this matter, General Motors will continue to replace the ignition switches on recalled vehicles as they enter dealerships.

  1. Why shouldn’t they be able to use the bankruptcy as a so-called “shield”? They now have new management and are clearly a new company that cares about their customers and their safety. Old GM pisses me off. Loads of atrocious decisions..

  2. Ditto! There is a segment of our sue happy society constantly looking for any reason to file lawsuits for gain when no actual losses occur. There’s no reason for GM to not try to insulate themselves by isolating those individuals from those with valid claims. It’s just a sign of the times and what our own judicial system and progressive society has created….
