Lawsuit Claims GM Falsely Advertising ACDelco Parts As Made In USA

The new Trump import tariffs have placed even greater scrutiny on U.S. manufacturing, with automakers now scrambling to pinpoint how much the new taxes will add to overall manufacturing costs. That includes both entire vehicles, as well as individual auto parts. Now, GM is facing a new class action lawsuit alleging that the automaker falsely advertises ACDelco auto parts as made in the United States, when in fact the parts are actually manufactured in China.

Per a report from Top Class Actions, the lawsuit was filed by plaintiff Norman Husar on March 25th in Ohio federal court, claiming that GM’s labeling practices violate the Ohio Consumer Sales Practices Act.

Husar claims he purchased an ACDelco automatic transmission filter labeled as “Made in USA” because he believed it was genuinely manufactured in the United States. However, when he opened the package, he discovered that the product itself was stamped with “Made in China.” According to the lawsuit, none of the other components on the filter indicated they were made in the U.S., either.

Husar argues that GM’s use of “Made in USA” labeling on ACDelco parts misleads consumers into believing they are buying American-made products, allowing the company to charge higher prices for parts that are in reality manufactured overseas. The lawsuit seeks to represent anyone in the United States who purchased an ACDelco product with “Made in USA” labeling, but where the product or its components were in fact not made in the United States. Husar is pursuing claims under state and federal consumer protection laws, and is represented by attorneys from Dann Law and Zimmerman Law Offices P.C.

The new lawsuit follows the announcement of sweeping new tariffs imposed by the Trump administration targeting fully assembled passenger vehicles and auto parts imported from outside the U.S. The new tariffs are particularly steep for products imported from China, while auto parts that comply with the United States-Mexico-Canada Agreement (USMCA) are not affected.

  1. If true I hope he wins and I hope it really hurts GM. I just bought some “Genuine GM” parts and paid more than for the aftermarket Chinese stuff. When they arrived and I opened the boxes they were all Made in China. That’s not what I thought I was paying extra for.

    Truthfully though GM is far from the only one doing this. I bought a bike some years ago sold as Made in USA. It was actually Made in China. When I inquired and tried to return the bike, they claimed it’d come from a US warehouse so it was, in fact, American. 🙁

    1. Regardless of manufacturing location, you generally buy “Genuine OEM” parts because they’ve been tested to a standard, not just replicated the design.

    2. Trump sells apparel (shirts and ties) that are made in India and Mexico. Yet he convinces his fanatics to buy that crap because he luts his name on them. No one has sued him!

  3. Also, no pic, no proof. I’m not saying it doesn’t exist, but I can’t find any evidence that a box has marked Made In USA yet the part says Made In China

    1. just got a ac/Delco starter Tues, box said made in USA, starter has sticker on it says made in china. Maybe box made in USA, it was a real nice box – lol

  4. There’s probably some loophole where putting the filter into the box qualifies as “Assembled in USA”.

  6. Some people believe the ACDelco store on Amazon is actually GM/Delco–not. My “Delco” tie rods lasted 6 months- dealer purchased now at 4 yrs

  7. This is a BIG problem and its not GM’s fault and GM has been battling this problem for a long time. Suing GM is really short sited and I feel bad for GM to deal with this as the owner is blaming GM. Apparently there is massive problem of Counterfeit Car parts from China with AC Delco on the boxes. They do it with MotorCraft too and Toyota etc. They flood the market with OEM parts and many dealers buy them from suppliers and many dont know really. Counterfeit China Semiconductors is also a issue.

  8. Thus why there is a Trade War. China rips off the USA all the time and the News Media does not know this. They Rip off American Businesses flood the market with counterfeit parts and also say they dont have restrictions to importing things to china but really do secretly.

  10. I got A/C Delco parts from Rock auto. Everything said made in China. And everything failed within 4 years.
