GM Claims Chevy Equinox, GMC Terrain Fuel Pump Lawsuit Should Be Dismissed

One year after the legal action was launched in May 2024, GM is calling for dismissal of a class action lawsuit related to a defective ACDelco fuel pump in certain Chevy Equinox and GMC Terrain crossovers.

GM bases its request for dismissal of the suit on the alleged absence of nationwide standing for the plaintiffs and a lack of proof that the automaker knew about the issue, reports CarComplaints. 

The lawsuit claims that the Chevy Equinox and GMC Terrain units affected are equipped with a fuel pump that lasts only half as long as it should, 100,000 miles rather than the allegedly normal 200,000-mile lifespan. Three plaintiffs, including a Florida couple and a man in Texas, filed the lawsuit in the U.S. District Court for the District of Delaware.

In both cases, the plaintiffs claim the vehicle’s fuel pump failed extremely fast, within a year of taking ownership of the vehicle. The plaintiffs also allege that GM dealerships replaced the defective fuel pumps with exactly the same component, leading to the failure repeating itself within a short timeframe.

Notably, GM has issued a Chevy Equinox recall and a GMC Terrain recall for fuel pumps providing an inadequate flow of gasoline to the engine. Both recalls were issued in February 2023, but only the Equinox recall matches up to the allegedly affected model year in the class action lawsuit.

The General says that the nationwide scope of the lawsuit invalidates its claims, since “the claims that Plaintiffs assert on behalf of nationwide classes […] are governed by the underlying laws of each state, and these laws vary considerably among states.” These include “unjust enrichment” claims as well as allegations that The General violated warranty law.

In calling for dismissal, the automaker also says that “defining the supposed ‘Defect’ to encompass any defect in those vehicles’ [fuel pumps] that cause them to ‘fail or operate intermittently’ is insufficient to show how GM could have known about (or fixed) the particular issues.”

The company also points out the issues described by the plaintiffs allegedly have different causes and were not reported during the vehicles’ warranty periods.

  • Both GM and Ford constantly do this and they just don't get that doing so sullies the brands.

  • Mr. Goodwrwrench died a long time ago. Grease Ball Mecca will settle after their outside defense attorneys milk the file sufficiently for a decent fee. If GM doesn’t settle and just replace the fuel pump, these people will just go to small claims court and sue locally where GM will be forced to send a lawyer. Corporations are required to have lawyers in small claims court. And they will drag the local dealership in to court and they are typically a corporation.

  • I can bet any amount of money that fuel pumps also go bad by dummy's running their cars with the fuel gauge on or near EMPTY to often or over filling the gas tank for that extra five miles of gasoline! I'm sorry but things on cars fail all of the time and there was already a recall almost three years ago plus GM was fixing this under warranty. I own a 2019 Chevy equinox I love it it's been very reliable I would but another!

    • Misuse and customer stupidity is legally foreseeable. Tire tech was not very advanced during the ‘60s. A kid died in his GTO when the tire blew at well in excess of the posted speed limit. GM was sued and tried to argue that the kid was speeding. The court said, no dice. GM built a muscle car and it was forseeable that people would do something like that. Plus they marketed it that way. The court opined that the penalty for speeding is not death. Same thing here. People “misuse” and “abuse” their vehicles.
