Earlier this year, Truck Series team Kyle Busch Motorsports (KBM) sued NASCAR Chevy team Rev Racing for alleged breach of contract in 2023. KBM, which is owned by active Cup Series driver Kyle Busch, has now been awarded an additional $105,000.
As per a report from the Charlotte Business Journal, Mecklenberg County, North Carolina court records dated July 8th, 2024 state a verdict has been reached. KBM went after Rev Racing, accusing the organization of breach of contract and unjust enrichment. Rev Racing allegedly failed to make payments to KBM on time throughout the 2023 racing season, missing several installments that had previously been agreed upon.
The lawsuit originated from an agreement between KBM and Rev Racing to field the No. 2 Chevy Silverado RST of Nick Sanchez full-time during the 2023 racing season. The partnership included KBM paying race entry fees for Sanchez while providing race trucks for each event, along with other undisclosed responsibilities. However, Rev Racing failed to make payments on time, prompting legal action from KBM in February 2024. KBM stated that Rev Racing owed the organization $325,000 plus interest for the initial lawsuit.
The case was then voluntarily dismissed in April 2024 as the dispute was resolved, settling on a $350,000 payout. Rev Racing paid $275,000 toward that settlement, but failed to pay the outstanding $75,000, which was due on June 19th, 2024. The court then ruled that KBM was entitled to a total of $380,000, which resulted in the $105,000 judgment amount.
As a reminder, KBM ceased operations as a NASCAR Chevy Truck Series team after the 2023 racing season and sold its assets to Spire Motorsports. As a result of the sale, Rev was adopted by Spire, bringing Sanchez and the No. 2 Silverado on board alongside Rajah Caruth in the No. 71 Silverado and Chase Purdy in the No. 77 Silverado.
While it is absent from the Trucks, KBM still fields race cars for owner Kyle Busch and his son, Brexton, in dirt racing and other motorsports events. Busch himself drives the No. 8 Chevy Camaro ZL1 in the Cup Series, which is fielded by Richard Childress Racing.

Legal fees to pursue the case were likely more than the settlement.
So unless a precedent was established, seems a somewhat wasted exercise.
So if someone owes you $375K to $380K, you’ll let it slide b/c you don’t want to pay legal fees? Yeah, Right! While we’re at it, could I borrow $350K from you? I’ll pay it back … real soon …
REV racing is a NASCAR corporate subsidized team as part of their diversity program. Question is, was this REV not paying on time, or was it really NASCAR?
