General Motors 5.3L Vortec V8 Class Action Lawsuit In Oregon Allowed To Continue

A class-action lawsuit filed against General Motors in Oregon has been allowed to continue through the courts after GM’s motion to dismiss the claim was denied.

The American automaker had a class-action lawsuit filed against it in the U.S. District Court for the District of Oregon, Portland Division in February of 2020. The plaintiff in the suit, William Martell, alleges the 5.3L LC9 V8 engine in the 2011 Chevy Silverado pickup he purchased new in 2011 has various issues related to excessive oil consumption. The suit is nearly identical to numerous other class action proceedings filed against GM in recent years, which allege certain engines in the 5.3L Vortec V8 engine family have several issues that cause them to burn oil at a higher than usual rate.

According to Car Complaints, Judge Michael H. Simon denied GM’s request to have the Oregon class action suit thrown out last week. GM had attempted to a warranty breach claim dismissed as the suit apparently did not mention any engine defects that would be covered by the automaker’s express warranty. The automaker’s express warranty coverage only applies to manufacturing defects, and GM has in the past successfully argued that the oil consumption defect is related to the Vortec V8 engine’s design and not a manufacturing defect or faulty component. The judge denied GM’s claim this time after scrutinizing the language in its implied warranty for “about 10 pages,” Car Complaints reports.

The judge also dismissed other motions filed by GM to have the suit thrown out, which were related to a claim of fraudulent concealment and a claim under the Oregon Unlawful Trade Practices Act.

GM has had several class-action lawsuits filed against it over alleged oil consumption issues with the Vortec V8 engine. The majority of these suits have been dismissed by judges, including a nationwide class action suit filed in Ohio in 2019.

  • 2008 Silverado 4x4 LTZ engine J LY5. First issue was the dash started cracking, folding mirrors stopped working, first driver side then passenger side, the engine would idle rough ever so often found to much oil passing through the intake due to a poor valve cover design, using oil at 45,000. It had increased to 3 quarts between 3000 mile oil changes. At 140,000 the engine had to be removed, rebuilt loosing so much power from burning oil. Come to find out sticking lifters and cam lobe damage. Due to the AFM/DOD engine management system, deleted it completely using new internal components, different cam, bored out .020 thousands, replace crank, piston rods, pistons, bent push rods. Lifters, weak valve springs, A total mess. The fuel pump went out, and the bed above the fenders were so thin they have rusted out, replaced with professional fiberglass panels both sides from E Glass industries excellent panels at a much cheaper price than new metal panels. I pride myself on maintenance being a marine mechanic. I see all kinds of issues, however this 2008 Silverado LTZ 5.3 should have not been an issue. Rear axle started leaking oil. turned out after seal replacement by a professional axle repair shop, lasted about 3 months had to replace everything excluding ring and pinion gear, axles and housing, metal was everywhere inside the housing. Went with tried and true Detroit locker components. GM should be held responsible for these failures. Transmission was not doing so good found weak internal parts and is being rebuilt by a professional company familiar with 4l60e issues on 4x4 Silverado's. I'm still in this rebuild process due to the fake president causing delays everywhere on finished goods and paying the people to not work, giving it everything he's got to collapse the United States of America. started doing this project Sept/2/2021. about a month longer to have complete. I've been buying new pickups for over 40 years, Dodge cummings were good excluding interior, Ford has issues, Toyota lasted the longest with no issues. Thought I would try a GM product. I thought it was a nice pickup I didn't want to buy another new pickup knowing the issues every manufacture has these days. So I'm building a better pick my way. My Granddad always told me GM builds vehicles to break just outside the warranty, he was right, Ford use to be the better vehicles, he drove the wheels of his.

  • I have a 2013 Chevy Silverado and I'm having the same problem with my 5.3 engine I got it from the dealership a year and 2 months ago and it lasted 40K now my engine's no good and they won't warrant my truck engine

  • NATHANIEL PRIOLEAU I brought a 2015 Chevy Silverado in September of 2015 and are having a noise coming from my engine and all so experiencing oil consumption.My mileage on this truck is at about 115000.

  • 98-07 where known for rusting on rocker panels and can corners I don't care where you live they all do it

  • Known for rusting in rust areas, down south they certainly don't rust. Come to Texas, you won't see very many that have rust...

  • Like the skill GM has with the cyl deactivation that still fails.
