U.S. Government Sues EZ Lynk Over Defeat Devices For GM Duramax Engines

The United States government has sued EZ Lynk, a manufacturer of emissions defeat devices for GM Duramax engines and other diesel powerplants, for violating the federal Clean Air Act.
EZ Lynk produces electronic engine control devices that allow users to disable the emissions control software in Duramax and other diesel engines and adjust other engine settings for performance benefits. The company’s Autoagent device includes a deletion software for the vehicle’s factory emissions control settings and provides the user with access to a cloud-based platform that stores the new software. A smartphone app allows the user to pay for and install the new software and adjust various performance settings on the fly.
“Emissions controls on cars and trucks protect the public from harmful effects of air pollution,” U.S. Attorney Audrey Strauss said in a prepared statement. “EZ Lynk has put the public’s health at risk by manufacturing and selling devices intended to disable those emissions controls.”
The lawsuit is seeking civil penalties for Clean Air Act violations and includes an injunction against further EZ Lynk system sales and installations, Reuters reports. Defendants in the case include EZ Lynk’s founders Bradley Gintz and Thomas Wood, along with an affiliate company called Prestige Worldwide. EZ Lynk is based in the U.S. Cayman Islands.
The federal government has begun to take aim at producers of aftermarket engine tuning devices in the wake of the 2015 VW diesel emissions scandal. Back in 2018, the feds slapped a company called Derive Systems with a $300,000 fine for violating the federal Clean Air Act. The company was also forced to spend $6.25 million in order to bring its products up to code in accordance with the Clean Air Act.
“Defendants shall not manufacture, offer for sale, sell, convey, or otherwise transfer any product intended for use on vehicles of model years 2000 and newer that contains user-adjustable features for the following: rear oxygen sensors, EGR, or any DTCs associated with these emission controls,” the federal government said after the ruling against Derive Systems.
The federal government’s case against EZ Lynk has been filed in U.S. District Court in the Southern District of New York.

There’s always going to be that small group of guys that gives diesels a bad name but the majority of people deleting their emissions are everyday citizens and businesses simply trying to keep their trucks running. Emissions equipment is the #1 cause of engine failure and downtime on a modern diesel. Diesel engines run more efficient and last much longer when deleted. Many of these trucks are actually burning cleaner when tuned as long as driven properly. Not to mention the increase in fuel economy and the millions of DEF containers that are no longer hitting the landfills. As always big brother knows best, what an exciting time we live in!
Well first of all yes, the tunes make the engines far more reliable and run much better.
But they certainly are not cleaner, that is just a given.
As far as plastic, toss them in a land fill and we will probably mine it again 200 years from now. I’m not worried about that. Nothing more than just an overdramatic stereotyping of how ” Evil” and “Bad” lands fills are.
Where do you think your garbage is going to go? It is either buried or burnt, virtually nothing gets recycled in practice. People are out of touch with reality.
I agree that not all are cleaner, but I never claimed all were, I simply said “many” witch has been tested by certain manufactures when running an economy tune. An economy tune is what a lot of guys run the majority of the time. Yes there are also guys that run the higher performance tunes the majority of the time, but as another poster pointed out they are finding that the ammonia emissions from the DEF system are actually polluting more than the visible smoke. Lastly I’m not trying to argue the function of a land fill, I was just making a point that the DEF containers create unnecessary waste.

If engines are far more reliable and run much better, then overall are they not better for the environment? Producing new engines and parts to repair or replace older ones, if you include the raw materials used, the processing, the manufacturing, the transportation and the labor, there is an impact that should be considered (measured) in any evaluation of a specific technology.

Same old lie that no one can back up with facts. Show us a nationwide study documenting that emissions are the main cause of current diesel engine failures. Don’t give us a link to a YouTube clip, or an anecdotal story, but give us an actual study that we can read, see who provides the data, etc. I always ask for proof and people never provide it.

Just look up 6.4 powerstroke emissions issues. They are ticking time bombs unless they are deleted it costs a fortune maintaining those POS.
My ’05 diesel Excursion costed 14k of waranty work because of the emissions system. Go figure.

Emissions control cause no widespread problems with current diesel engines. Who cares about your 2005 example and if it’s true. it’s 2021.

Emissions systems have gotten MUCH WORSE since my ’05. That was the last of the diesels that still only had a cat.
Ever seen many Cummins go into the shops with 10 to 15k bills? Guess not. Ever see a Ford or Chevy with a 10 to 15k bill? Obviously not.
I have and seen many, why do you think the aftermarket world makes these products and tunes? Because the stock ones were so great?!

John is correct, anyone who works around modern diesels will tell you the same thing. No one is going to spend the time and money to create a nationwide study. I have seen it with the company I work for. I have seen it with my own truck. I have heard and read about it from countless others. Just because your truck has not had issues yet does not mean it’s not happening. The better question is why are you so triggered?
I’m sorry but yes. One of which is the EGR system. What happens is that the engine is recycling its unburned fuel back into the engine. Often the recycled mixture goes through a cooler. But that simply means you a putting that sludge back into the engine and prematurely ruin the motor.
They are currently working on deleting the EGR system over all, making the engine run as clean as possible and any unburned mixture, will be cleaned off by DOC, DPF and SCR.
Here is the deal. The EPA laws were passed by Congress and the House. They are explicit on what they cover.
Now during the Obama administration the people appointed not the EPA reinterpret the laws to fit their own agenda.
This is where the fight for the RPM law came from. They tried to ban modified cars from being raced even if they were not street cars. This would have devastating effects on the grass roots racing and drag racing. There was a bi partisan push back on it.
Then the Trump Admin came in and the EPA followed the laws as passed for cars.
Now new progressive appointed Biden staff at the EPA is back to banning any changes to ICE vehicles on or off road. The RPM act is now in the court system and in for the long fight.
Many states are adopting the CARB regulations in California where they are very restrictive and damaging. Even if a car runs cleaner on modifications it matters not to them.
Other NE states are trying to ban cat back exhaust that changes nothing on emissions.
It is a future like this that had driven automakers to push harder for EV models as it will only get worse.
I fully expect the auto hobby will be hit in states like CA and NY with higher taxes on older cars or limits to when and how much you may drive a collector car.
In places like England Richard Hammond was hammered by his local government for the number of cars he owns. He wants to build a large building to store them in but was rebuffed with you should sell them from the local politicians.

There is no known way to make diesel engines emissions free. Power systems yet to be imagined will make obsolete all combustion engines.

This suit was needed as many folks forget that freedom involves responsibility and how are we individually going to be responsible for people getting emphysema and cancer that the pollution that we are individually generating? My wife obtained her doctorate in chemical engineering studying the physiochemical properties of aerosols. She has, and continues to, work with Cummins, John Deere, Fairbank Morse, Harley Davidson and others on controlling particulate matter emissions.
To quote a lead engineer from Cummins “internal combustion engines spew a host of toxic garbage, we just try to control a few of them”

None of these systems have a reputation for running efficiently either. They are not designed to “turn a profit”, but that does not mean that they are all well designed and built to be effective. Okay, don’t focus on Cost because you don’t want to obsess on
the dollar”, but don’t be surprised at ridiculously high budget overruns and mediocre outputs.

I’m sorry to burst your interpretation of an illegal truck as my 05 Ram came stock with 4” exhaust from the turbo back to tailpipe. I added a tuner for improved mileage and get over 20 mpg and have never had any problems with the engine. Also I have tried several fuel additives that claim to improve mileage and they all actually decreased my mpg and I no longer use any of them. In the meantime I have been stuck behind various gasoline powered vehicles that are emissions exempt due to the year built that smell terrible. So run your vehicle of choice legally and respectfully and everyone benefits.
Excuse me sir, my Duramax smells better than your wife’s perfume, the exhaust is 5″, the coffee can is 8″, and makes the sweet sounds of girl on girl love and bald eagle freedom caws. And it does NOT bellow black smoke, because dumping that much more fuel than you can burn is idiotic. Over 500 buff ponies and there’s a tiny bit of black smoke on immediate throttle before the turbo spools, but anyone with coal rolling tunes are the problem. I want the Fords I’m dusting to see what they’re getting dusted by.

Other than the guys who max out their power or just wanna roll coal, deleted diesels can burn cleaner than stock emission equipped ones. For years people who have had to get their diesels emissions inspected have done “stealth” deletes where everything is still intact but hollowed out and deactivated. They just put on the economy tune and they pass. A new dpf free stainless exhaust (that still uses the nox and catalytic converters), egr delete kit and tuner to run it all is less than half the price of a new dpf filter that’s just gonna fail again after releasing the same amount of soot as a system without one, and still pass emissions.
If diesels could run cleaner and more efficient with all these hacks and deletes and still pass emissions, why doesn’t the manufactures do it? Because the engine had to work under a wide temperature environment, altitude and load. Because someone like you putting it in economy mode, the local authority will get eise to it and they’ll be checking. VW tried it and lost big time.
Why do you THINK none of the other diesel manufacturers were given the same tests as VW? News flash buddy – its cause they are ALL doing it – because the goals set forth for emissions standards are simply IMPOSSIBLE to obtain. You’re asking the same size engines to run 3 times the amount of systems – all in the name of “lower emissions” that come at the cost of making the engine more INEFFICIENT by adding all this additional equipment. Or have you never wondered why a water pump for a modern diesel is 3 to 4 times the size of the same displacement engine from the 90’s?
With tuning and delete kits on modern diesels, you can literally increase the HP by 50% – and DOUBLE the gas mileage at the same time. Thats how inefficient these engines are forced to be from the factory. Also when people are having to pay thousands to replace an exhaust system and filters – you are just BEGGING the public to find a cheaper alternative. Even funnier – is the gov forcing manufacturers to do this – is just keeping 30 year old diesel trucks on the road longer , cause the average person doesnt have 70 grand to spend on new model, which just drives the demand for old models UP. Logic is amazing, aint it?

DEF diesel exhaust fluid
The worst part of all of this, is the Federal government knows that the emissions equipment on all diesel trucks today cause reliability and longevity problems. If anyone wants proof, look at modern ambulances that are diesel. Regardless of brand, they get a emissions exempt card…literally. There is not a single ambulance in my town that isn’t deleted. They get a pass because someone dying due to the EMTs forgetting to put in DEF, or the DPF gets plugged is asking for a lawsuit.
Military vehicles as well, I just saw a video of brand new Cat dozer built for the military with zero emissions equipment.
Military has always has EPA exemption. So yes, they buy the Cat equipment with no emissions (typically still mechanical motors) that are typically only available in 3rd world countries

Folks this is not just diesel but all ICE out there. The EPA is targeting all and this story is just about a Diesel tuner.
I have seen a number of gasoline tuner companies that have been attached and fined by states and even driven out of business.
Casper made O2 simulators for racers. But they were fined and charged by a few states and the company failed. The time is coming local tuners and other mfg of tuners will be charged and fined.
California already has fined companies over the useless spouts they force that seal nothing. But companies were fined millions over this.
Biden’s choice for the EPA can really do a lot of damage here to many companies, racing and auto enthusiast.
Now you can see why GM has gone all EV as this drops much of the ever changing government grief. Once GM saw that they could make the numbers work to make money they announced the change.
No wonder folks go aftermarket with the tuner kits and emissions delete kits.
The OEM parts are 2 to 4 K not counting labor. Dealerships treat customers as idiots and threatening not release your rig or turn you in if you modify YOUR vehicle. I get the emissions and purpose of it, but make it affordable for the regular working guy. A used rig worth 20-25 k …..and you gotta pay 5k plus for new parts (dealer only) and labor on the exhuast system…..they will not replace a sensor , but the whole system only REALLY. Any body can by a parts changer. I maintain my vehicles, but this just not make good business sense or ROI for me. I paid almost 60 k for my truck…..dealer trade in is 12k now ( 85 k miles) …only on a new rig purchase. The other thing is the DEF aka (cow piss). You figure we would have something a little better by now.

Show me a study documenting that DEF and or emissions control systems cause major engine issues with current diesel engines. Hint, there isn’t one… I’ve no problems with my 2017 2.8 L Duramax and it’s emission control system.
Whenever I ask someone to back up their claim regarding emissions control systems wrecking diesel engines I just get an anecdotal story about themselves or a “my buddy…” story.

Your light duty 2.8 Colorado not having problems (yet) doesn’t make you an authority on the subject. The heavy duty working class of trucks are the ones being hit the hardest with emissions problems. Your not going to read about it from the main stream media for many obvious reasons but it’s still a very real issue.
My 2 diesels get better fuel milage and less emissions than a new truck. Its all in the programming. Scored 2 points lower than the 2 new def equipped trucks in front of me. Its all about NOX gas and temperature.

Anyways, I understand emissions controls help but this is an aftermarket mod and the risk/civil penalties should be the vehicle owners responsibility. “Diesel gate” was a different matter. That was the manufacturer intentionally skirting emissions regulations and not a performance modification.
And we delete our trucks to get fuel milage.. sooo how does all this dpf emissions help when it makes out fuel milage go down?! They’re doing this for another reason bet
I think most guys here that modify their diesels were not around during the 1960’s & 70’s. The purpose of the EPA to to keep the crap out of the air that we all breath, it’s not about better fuel mileage. I grew up outside NYC and we would visit family in NYC, you could smell the diesel fumes in the air. NYC transit ran thousands of diesel buses everyday belching out black soot plus tens of thousands of diesel trucks. One time I flew into Minneapolis around 1978 and you could see the soot cloud laying over the twin cities. LA was worse. Now you get a big head thinking that messing around with emissions is good for you but not for everyone else. If I had COVID and coughed in your face would you like it. Your coughing your exhaust in my face and I don’t like it.
Because of the EPA, technology finally caught up and todays ICE gas engine are incredibly clean and the MPG about doubled from forty years ago. My 73 Charger had the 318 with 140HP on leaded gas and got 14 MPG. My 2019 455HP 6.2L Camaro get well over 25 MPG on the hwy, closer to 30. Local around 22 MPG. A 1974 454 Silverado got 3-5 MPG. I had one.
Your knowledge of history relative to vehicle emissions is spot on. I live in NYC and grew up with gasoline and diesel exhaust. Back then, diesel exhaust smelled great when i was a kid. ’60’s muscle cars went away due to manufacturers crying crocodile tears, unable to control emissions. The same manufacturers today are spitting out some of the highest horsepower cars, pickup trucks and suvs with tight emissions controls, many with more hp than ’60’s muscle cars. These same manufacturers refused to pay royalty rights to Bosch for its invention of electronic fuel injection, failing in their attempts to create their own version. They quietly adopted what’s now standard, Bosch world wide EFI systems. Coupled with engineered emissions control systems and some of the very best EFI engines with tremendous hp are sold in compliance with EPA regulations.
Diesel engines in NYC buses are no longer belching soot. All emissions controlled and zero smoke plus extended tail pipe upwards to expel smokeless exhaust above everyone. The smell is nothing like diesel exhaust of old days (DEF fluid?). We have tandem buses and they haul ass too.
Unfortunately, diesel manufacturers may be in the teething phase of diesel emissions controls similar to auto manufacturers facing designs of emissions controls for cars and pickup trucks in the ’60’s (suvs didn’t exist back then). Science and technology overcame the uphill struggle of auto exhaust emissions. Perhaps diesel’s turn has come and initial versions are just that until tweaking things to allow greater power befitting diesels along with better emissions controls not strangling them as they are presently. Time will tell.

All the emissions numbers is a pile of garbage. These engines are sniff tested at idle, not at any other load. Once the engines go under load, the regen system runs more often then not. How does it do it’s job?……by dumping piles of fuel into the exhaust to ‘burn’ off contaminants. They burn more fuel to labor through the regen process. EPA doesn’t, WON’T, check the emissions numbers under load because all their years of inflating their chests will be discredited, they’ll look like the **tards we all know they are. These aftermarket tunes and delete Systems unlock efficiency and power. In turn, a well breathing – well running engine, will burn much more efficient and have considerably less emissions. The manufacturers can’t make them this way because they are governed by EPA. Judges and lawmakers are too blind, or blinded, to see the truth. It will never change. Very unfortunate. Say hello to life as portrayed in the movie “Demolition Man”, we are almost there.

Show us the study that DEF kills the economy and performance of diesel engines. My Chevy Colorado with the 2.8 L Duramax is averaging over 27 mpg on the highway. Truck runs great.

Studies are starting to show that the ammonia emissions from the DEF systems actually contribute more to smog than rolling a bunch of soot out the back….also the mining for making these EV batteries is worse on the environment than driving a gas vehicle for 200k+ miles.
