Settlement Reached In Class Action Oil Burn Lawsuit Against GM

Earlier this year, a class action lawsuit was filed against General Motors over claims its 2.4-liter LEA Ecotec four-cylinder engine burned excessive amounts of oil due to a design flaw related to faulty piston rings.

Now the judge presiding over the case has approved the settlement terms between GM and owners of affected vehicles, which will allow them to have the 2010-2013 Chevrolet Equinox and GMC Terrain vehicles inspected and repaired if needed. The customers will also be able to receive reimbursement from GM for repairs they paid for out-of-pocket in an attempt to remedy issues with the engines.

The last time we checked in on this case, Judge Robin L. Rosenberg had put it into a holding pattern after customers objected to GM’s settlement terms. Judge Rosenberg wanted GM’s lawyers as well as customers’ lawyers pursuing the class action suit to agree to more “robust” settlement terms, as the initial settlement would not allow them to receive full engine repairs or replacements – only piston ring assembly repairs. The new settlement has more specific terms that will allow for “reimbursement for repairs and/or replacement of engine components that are or were required and solely caused by excessive oil consumption due to piston ring wear.”

Judge Rosenberg also wanted GM to personally reach out to owners of affected vehicles who had previously opted out of the settlement due to being unhappy with its terms. According to Car Complaints, GM will mail claim forms to 1,709 customers who opted out of the settlement, giving them another chance to participate in the revised settlement. Other owners of affected Equinox and Terrain models will also receive letters in the mail notifying them of the settlement.

The class action suit started out as three separate cases, which later consolidated into a single case that was heard in the U.S. District Court for the Southern District of Florida. It alleged that affected vehicles with the 2.4-liter LEA Ecotec engine may burn a quart of oil for every 1,000 miles the vehicles are driven. It also claimed the engines may have faulty spark plugs, low oil pressure, damaged timing chains and might produce a knocking sound. In some cases the engines would fail completely, according to court documents.

  1. If anyone has friends that have these engines that are over the warranty period, go and talk to the GM dealer anyway. They have ways to get an over distance vehicle covered by warranty. It costs nothing to ask and if you or your friend bought the vehicle new from the dealership where you are trying to get this back warranty situation covered, make sure you tell the service adviser or service manager that you are a repeat new car buying customer.

Mid August came and went and I never received a check. I called again in Mid Sep, spoke to someone, he told me checks were going out mid September. It’s Oct 19 and I still have not received anything. I’ve called the phone number and now I’m just left on hold for 30 mins or more, no one ever picks up.

      1. The class action suit is only for the Chevy Equinox and the GMC Terrain, even though, I have read certain Buick models have the same issue, they are not covered. I own a 2012 Terrain – bought it new. This suit is a joke as well. If you have 120,000 miles or more you are not covered. My car had 125,000 when I got the first letter from GM. If you have paid out of pocket for engine repairs, you have to PROVE it is directly linked to the oil consumption issue. Trust me, GM has versed their customer service folks not to put anything in writing so it can’t be proved! I will never give GM another penny of my hard-earned money.

      1. This issue was also covered by GM several years ago. I had an engine go due to oil consumption issue and replaced it with an engine that the timing chain went a year later (35,000 miles on replacement engine).

It looks like I will get reimbursed for the oil consumption replacement but I am too late to take action on the timing chain issue.

The 2.4L Ecotec was just a bad engine on multiple levels.

        3. Hi David, we have a 2013 Terrain that we were told it needs a timing chain or a new engine. Was the engine you replaced yours with a new or used engine? We thought we had decided to replace the engine with a 6K price tag but will reconsider after reading your comment.
We also missed the lawsuit option and the car burned through so much oil we carried a case of oil in the car. This consumption didn’t keep the chain lubricated and caused th timing chain to go bad. It’s ridiculous, what a lemon of an engine.

    7. I have taken my car 2011 GMC Terrain to my GM dealer and was told that the GM notice in 2015 of my GMC Terrain the possibility of oil consumption has expired even though noting “do not take your vehicle to your GMC dealer as a result of this letter unless you believe that your vehicle has the condition as described above.” I did not have an issue at that time. I saved the letter. My Terrain only started it oil consumption November 2020 with 58,000 miles. The service manager told me that the date of service was the date I bought the vehicle which was 2011and the seven years and 120,000 miles was the end date and GM was not noted to do anything beyond that date. I was not offered any compensation from the dealer but was offered to bring my Terrain in and they will check my oil. I got better service from my mechanic than I can say from Bill Marsh Dealership. Their response to my survey gives me a number to another GM dealer downstate. I won’t be buying from a GM dealer any time soon.

One month after I bought it, I found out there was a class action law suit that had ended the month before. Even though it is a 2010 model it only has 69,000 miles on it. Last week the timing chain broke and messed up the valves. This should not happen with a vehicle that has this low mileages. I have it service as needed. It should be a RECALL, not just a class action claim

    10. What Bommarito should have known about the GMC Terrain – Yet sold it to us anyway…

I bought a used 2014 GMC Terrain from Bommarito, Hazelwood Mo for $13000.. with 89000 miles.. drove it for about 3 weeks… it started shaking at every stop… took it to my Clark auto service.. they informed me it was 3 quarts low… How could that be I asked, the dealer delivered with a fresh oil change.. Then they informed me that it was common knowledge that the GMC Terrain has a serious oil consumption problem.. I wondered how Bommarito would even sell a model that has a known problem like this..So we adapted to that by checking the oil regularly… about a quart every 1000 miles or 2 weeks.. Recently, that wasn’t enough… checked the oil again.. added more.. . Back to the Clark Service: the diagnostic: Engine misfiring on cylinder # 3 due to low compression, low compression due to a burned-out exhaust valve… Clark recommended a new Jasper engine because of the extensive repair cost of $2500 – New engine would cost $6000.. I will never buy another car from Bommarito … for selling me a car with A class-action lawsuit filed against General Motors in 2019 stating that the excessive oil consumption is caused by faulty piston rings. Due to the faulty design, the engine burns about one quart of oil every 1,000 miles, causing damage and eventually engine failure. Jul 27, 2020.. Bommarito had to of known.. I will bad-mouth them to anyone who will listen…unless they step and do the right thing by me..

The GM 3.0 liter engines for the Equinox and Terrain are no better….experiencing many of the same issues as the 2.4 liter engines (excessive oil consumption, timing chain issues, etc, etc.) It’s a shame this engine wasn’t also included in the lawsuit. I sure wish to God that General Motors wouldn’t have done away with the 3800 engine. I’m getting way better gas mileage and reliability from my supercharged 96 Bonneville than I am with my 2010 Equinox LTZ. Absolutely shameful. It’s the same exact thing but my vehicle isnt included in this. I was never disclosed to me when I purchased my vehicle at Bill Walsh in Streator Illinois.

    1. Ryan, I have a 2014 Captiva, too. A week ago it had a sudden, catastrophic loss of engine oil in the cold weather. I have been doing some research and GM issued a special coverage adjustment for the 2014 Captiva back in March 2015 that extends the warranty on the Captiva to 120,000 miles or 10 years. This adjustment covers the checking and replacement of the PCV system which can fail in cold temperatures. From what I can see, the fact that our vehicles are covered by that, we should be able to successfully sue them for putting a defective engine in our vehicles. GM did the same thing with the Equinoxes and they were successfully sued for the larger problems that arose from the SAME engine we have in our Captivas. I plan to push this issue, via a lawyer, until I get reimbursed for the death of my car’s engine. I encourage you to do the same.

  22. We had the 2012 Chevy Equinox. We had an oil change at Jiffy Lube and less than 3 months later the Equinox makes a rattling sound and won’t start. We take it to the mechanic and they say it looked like we had not taken it for an oil change in months and as a result the engine cracked because of no oil and we would need $4,000 for a new engine. This happened January of 2019 and given not wanting to pay 4K, we were able to get $1,000 as a trade in for the vehicle even though it was worth over $4,000 running. As we took a $3,000 loss on the vehicle, am I able to recover any of the $3,000 loss I took on the trade in since the car was sold for parts?

First it was wouldn’t hold oil and all emissions sensors reading faulty so I could not register tags. Then after and oil change it started rattling. Took it back to oil change and they said oil wasnt that low and it’s a piston knocking. I dont have 4k available to repair out of pocket. Only 125,000 miles

If the recall is for 2010-2013 then only late model 2013s are eligible. Because Idk how many new cars sit on a lot for over 3 years. I cant get my car fixed and I owe. Shit out of luck. 32. I am dealing with this issue now with my 2013 GMC Terrain, it has 95K miles and the engine is locked. The dealer kept saying they needed to perform an oil consumption test but they couldn’t because there was no oil so the engine wouldn’t start. I told them that is why the lawsuit because the engine consumed all the oil, if it didn’t consume the oil they could do the test and a matter of fact if the engine wasn’t defective there wouldn’t be an issue thus there would be no lawsuit. The dealers and General Motors are working together to make the consumer suffer due to their defective product. I will NEVER NEVER NEVER NEVER purchase another vehicle from General Motors. Signed a VERY DISSATISFIED GMC owner.

  33. Been tracking excessive oil consumption recalls for 5 years. 2013 Equinox ECOTEC engine. NOTHING for years. No warning lights, low oil lights, nothing. Just kept pumping oil in and eventually it got so bad, the engine locked up. Then literally 2 weeks after engine blows, a Class Action Lawsuit was settled. Judge held off signing off on lawsuit because GM was pushing back on having to pay for blown engines. Judge even commented that was the reason why he held off on “final settlement.”
Take car to dealer immediately, receive Class Action Paper work in the mail, hear from GM customer service, told I have a STRONG CASE. Don’t hear anything for 3 weeks. Renting cars, trying to manage without a car, and still nothing. Dealer finally calls after calling GM numerous times only to be told that GM would pay part of the new engine cost and I would have to come up with $4,500 to cover the cost. Reached out to the company handling the lawsuit… they basically laughed at me and said, “Take what they are offering because they aren’t offering much.”
GM went silent. Would not return calls, would not return emails. Sent a complaint to the GM website voicing my concerns, then low and behold, started receiving emails again telling me they are still working on my case. In the meantime had to pay Chevy dealer $4,500 to have engine replaced. Car wasn’t even worth $4,500 but have 3 in college and trying to make ends meet.
Finally received a call from Ashlyn and GM customer service, not the same person Rachel I had been working with….only to be told that she was sorry I had to come up with $4,500 to fix my engine, she wasn’t the legal department and basically i was out of luck! So sad that I try and support American Auto Makers because I love America and want my fellow Americans to do well, and they produce crap and don’t back it up!
NEVER BUYING GM PRODUCT AGAIN and I ENCOURAGE EVERYONE TO SUPPORT. Maybe they will wake up and start producing quality products like our parents and grandparents produce and Made American Automobiles Great!

  36. I was sold my 2012 Equinox by a dealership just shortly after the coverage had ended for the service bulletin and it had 125k miles. I Had no idea these vehicles had these types of issues. I got 10 miles from the dealer the day I bought it and my problems began the check engine light came on and it was pulling multiple trouble codes. Called the salesman immediately and was told they were closed I’d have to call back Monday. We lived 3 hrs from this dealer. Before we ever made it home the engine had began to sound like a diesel and was making so many loud noises that it didnt on the short test drive. We never could get the dealer that sold us it to help in any way they denied any issues although it was later obvious the battery had been unhooked to clear the engine light. We replaced a few sensors and thought things would be okay but nope! We checked our oil a week later and it had none whatsoever in it. We filled it and then took it for an oil change as the sticker in our window said it was time for one (something else the dealer didn’t do b4 selling it to us). We took it to the dealership twice to see if it was leaking oil because we were putting multiple quarts in it a month. Fast forward to April 2020 the car now has 130k miles (only 5k miles driven in 10 mo) my family and I go to leave to go to the store and the engine sounds horrible and it then quits we had just put 2 quarts of oil in it the week before. My husband checks the oil and again bone dry. Never once did a low oil light or any type of warning light came on! We try putting more oil in it and attempt to start it again and it starts running very rough but shortly dies. We have it towed to our local gm dealer whom informs us because of the excessive oil consumption the timing chain jumped time ruining the entire motor. When i financed the car I was forced to get a service contract or they said I couldn’t get financing with my bad credit. After a month of fighting with the service contract they denied my claim for the repairs stating I allowed it to run with no oil. Livid was an understatement! So I was then responsible for the entire teardown and diagnosis plus the cost of the new motor and all the labor. I ended up paying out $6k for the work + a rental car for the month it took them! I still owe $7500 and the car is not worth anything! I contacted Chevy who basically told me too bad, the dealer who did the work told me the service bulletin had expired 02/19 which was 4 mo prior to me owning the vehicle and at that point it was over the mileage anyways as I bought it with 125k miles. I guess its safe to say I also missed the class action lawsuit? Its been a month since I’ve had the car back and 2 days later the check engine light came back on so I take it back to the dealer who did the work and was informed the catalytic converter now needed replaced because it was contaminated with oil when the motor failure happened. They originally told me when they were diagnosing it that they did see a bit got in it but it would not need replaced. They want another $1300 for that work. The so called new motor they put in was actually remanufactured even though it cost such a ridiculous amount! Im so upside on my loan and so much negative equity I’m basically stuck with it because I don’t have great credit. The new motor doesn’t sound much better than the old one did its noisy and has slight misses at idle. It’s already showing to be consuming oil also only 1 month and it’s already a quart low again! I guess people in my situation are just supposed to suffer while GM makes millions and doesn’t stand behind their defective junk! If anyone knows how I can still get in on the lawsuit pleaese let me know! I may try to consult with a lawyer about the dealership who sold me it and concealed serious engine issues. No doubt that the motor had already had excessive damage when they sold it to us.

  39. The issue does not stop at the 2013 models, I just had the same problem with my 2014 2.4L ecotec engine that just turned over 100K miles. I have had issue after issue with my 2014 GMC Terrain and have only had it 3 years. AND not to mention that all of these parts were replaced bc of oil/engine problems 3 months after buying the vehicle. I just had to have the timing chain replaced and now am driving my vehicle knowing that the exhaust manifold is cracked and leaking, bc I couldn’t afford more repairs and still $8000 on my loan. And all of this stems from the oil consumption issue. The dealership that just did the recent repairs told me that i will have to check the oil level regularly bc of oil consumption issue. I am thankful that my warranty has cover a majority of these repairs, yet I still have had to pay $600 out of my pocket so far as a result of the faulty engine. The thing that is unfair is that I am now stuck with a vehicle/loan that I will continue to have problems with and will inevitably cost me WAY more out of my pocket that I shouldn’t have to pay. I am not at all pleased with this and believe that the 2014 should be included in this class action law suit!

    1. Typically todays cars should not have any kind of detectable odors after shutting off.
If you are experiencing gas smell you should have it checked out sooner than later. It could be an indication of leaking fuel lines, tank or a number of other issues. It could also be the reason for the stalling on account of loss of fuel.
This has the potential to be very dangerous. Do not put it off.

“Due to the 60 day extension of the claim filing deadline as a result of the COVID pandemic, the review process and reimbursement timing has been delayed by 30 days. We now anticipate deficiency letters and timely, eligible reimbursements to be sent in mid-September.

If your claim is determined to be deficient you will receive a notice by mail explaining the deficiency, the steps you will need to take to resolve the deficiency, and the deadline that you must respond to the deficiency notice by.”

      Reply
      1. Yeah that wasn’t GM that was your dealer. 500.00 sounds like a deductible. This has nothing to do with a warranty. GM has to honor your claim in full. Either your dealer is uneducated on this matter (which they shouldn’t be.) Or they’re trying to screw you. My advice is to call GM service directly and inform them of them of what happened and give them the dealer name and who you spoke with. …. Or your lawyer.

I spent close to 8000 in repairs, consultations, rentals cars and ultimately an engine replacement while GM told me my 2013 Terrain wasn’t a part of the settlement (even after arguing that my car was displaying all of the problems listed in the class action) but then sent me paperwork that said was. I have been calling every Monday since 8/21/2020 to get a status update on my claim and every week they tell me the same thing over and over again. Nothing new has come in on this claim – should know by Wednesday or Thursday if you want to give us a call or even into next week – checks on approved claims should go out Mid September – wait now its Mid September to Late September. But here we are October 5, 2020 and I was told the same thing. And I always speak to the same person Brad. This whole thing is a little fishy to me. Today I told him I wanted to speak to someone above him because I feel like they are playing a game with us. He said check dates are never exact and we don’t give exact times. I said well that is funny because you auto recording for updates said MID TO LATE SEPTEMBER CHECKS WOULD GO OUT. So maybe you should change that. Getting very irritated. I have $2,165.87 in damages I am looking for back from my vehicle since I started this whole damn thing with the dealership and said why the hell isn’t this stuff recalled. End of rant. Good luck.

I am afraid of the language used what qualifies as a legitimate claim of expenses? I am afraid I may have submitted my paperwork and the work done may be deemed not reimbursable. I am hoping that if claim is rejected I am sent an explanation rather than wait for a check that may not ever come.

    1. the way it was explained to me, was; if you had repairs due to excessive oil it would all be reimburse 100% but and the midst of the repair you asked them to replace your brakes pad etc or anything that had nothing to do with the oil consumption that part of the bill would not be covered. hope this makes sense.

  100. I brought my Daughter a used 2011 Chevy Equinox from a dealer, We were never informed about this engine burning oil, needed to be checked every 1000-1500 hundred miles, Once she received the vehicle we had nothing but problems, It was given back to the dealer and they informed us that there was a recall on one of the engine parts, This vehicle was with them for 3 weeks and we finally got it back, As of right now we were just told by my mechanic we need a new engine, This will cost over 5,500 dollars. The said part is they have to put the same engine in which will burn oil and if you don’t stay on top of this, The same thing could happen again. Pretty sad when dealerships know this information, yet they forget to tell the consumer, I just found out today about this class action suite, Please anyone out there let me know if I have a leg to stand on.

Mid August came and went and I never received a check. I called again in Mid Sep, spoke to someone, he told me checks were going out mid September. It’s Oct 19 and I still have not received anything. I’ve called the phone number and now I’m just left on hold for 30 mins or more, no one ever picks up.

  103. I feel really bad for those that did not know about this class action lawsuit until after the deadline had past. I’m assuming from most the comments, that most of you had complete engine failure? My 13 Terrian jumped time and the pistons were bent so my engine had to be replaced- 6k. Since then, the rebuilt Jasper Engine has failed 2 more times, but it is under warranty but still continues to consume oil no less than before. When I pull into a gas station I tell them to check the gas and fill up the oil. On another note, I was involved with another class action lawsuit with Western Union that I filled out the paperwork in 2014. I received my check in April of 2020. I hope this doesn’t take as long.

Then checks are starting to go out…..It is getting very frustrating considering many of us have been waiting for years for this reimbursement and we don’t even have the vehicle anymore because it caused so much headache.

I then received th4e letter in the mail back in July in regards to the issue with my car. I took it in for an oil consumption test and the service manager told me to not add oil in my GMC that in order for the test to be done correctly it needed to all be done at there location. After 2 oil changes with GMC I told them my car was shaking and it felt like something was very wrong. He said bring it in for the last oil test and we will have more information. I did I was I was directed and MY ENGINE BLEW UP! It has now been sitting in GMC dealership for a month and nobody will call me back and they have no intention of repairing my car. One is, to bear in mind buying automobiles that are within the good set of car insurance firms. Cars which have been expensive tend to be more at risk of being snatched. Aside from that insurance policies are also in accordance with the value of your car or truck, so the costlier it is, then higher the particular premium you only pay.

  133. Hello everyone, here is some update for my case. I filed the claim in April 2020 and today I received the mail but it’s the notice of claim denial. The reason is “The documentation provided with your claim does not reference or provide any indication that the expense reimbursement sought in your claim was due to engine oil consumption caused by excessive piston ring wear. Accordingly, the expense you sought in your claim are not eligible for reimbursement and your claim is denied.” I spent $1400 to replace my timing chain in local mechanic shop, I was told the timing chain damage was caused by the excessive oil consumption and most likely the excessive oil consumption was caused by the excessive piston ring wear however the shop didn’t tear the engine apart to inspect/replace the piston ring because it would be much more expensive than just replacing the timing chain. Now I realize that the “c/o Analytics Consulting LLC” set the condition/language for reimbursement very strictly so that they could deny as many claims as they can. We have to prove that the expense you claimed is directly due to the engine oil consumption caused by excessive piston ring wear, otherwise I don’t see anyone could get the money back. Any suggestion from legal or technical perspective? I have 10 business days to contest this denial by mailing back with detailed written statement and supporting documentation. Thanks folks and appreciate your advice.

  138. I received my letter today Nov/17/2020 of denial saying my repairs were completed outside the time. Specifically , the Sca time limit for my 2010 vehicle. Because the repairs were completed after the SCA period had expired. My vehicle was within 10 years old and under the mileage. I submitted the service repair in which the Vehichle died and was towed into a dealership last December 11, 2019 so 12/11/2019. They say the date was 12/14/09 SCA so it was in before that however, it was not fully finished until 1 month later 1/28/2020. My vehicle wasn’t even 10 years old and had 105, 544 miles on it. Mailed the form on 02/02/2020. The total was 2171.75 then another 177.03. I got the vehicle last yr and not even 6 months after owning it all that happen. It did say tech found engine not running / excessive engine damage due to lack of lubrication due to engine oil consumption. Disassembled engine and found oil pump and pan full of debris sent head to machine shop and reassembled engine. Engine tech found special coverage for pistons and chains per coverage 14159 tech found chains broken and all valves bent tech replaced pistons and chains. Vehichle was documented in shop on 12/11/2019. I sent pictures with original documents and proof of my vehicle. Its a 2010 Chevy Equinox my vehicle was less than 10 years old and brought in before the sca date why would I get a denial letter stating sca period had expired. Hence my claim is not eligible for reimbursement and is therefore denied. If I wish to contest it have 10 days. I just received this letter today. I called every two weeks until a week ago talked to the same man there told me to call back in two weeks since March. I need to pay the loan I had to get a 35% loan on to get the vehicle out. This lawsuit is over. But, the car was not 10 years old i cannot understand this at all. Isn’t there something that can be done? Its was in before this sca date of 12/14/2019. What else can be done or who can you talk to? Don’t understand.. sca date the vehicle is a 2010 its 2020 thats all that should matter for 10 yrs. And, my vehicle was in the shop on 12/11/2019 the sca date is 12/14/2009 so I, was in for that reason and I got denied because they didn’t finish it until 1/28/2020? Why?! Can anything be done here?!!!

But my question is…Is it even worth it at this point to contest? Did anyone receive an approved claim? I would bet my paycheck no one will receive a settlement.

    1. It’s still possible that someone got the claim approved so then usually they won’t bother to find this forum to discuss this issue. But I agree with you per what we’ve seen by now that obviously this law firm is trying to deny all the claims as their initial response. If someone just gives up, they just pay one case less. If someone contests, they might look into the specific case to see if it’s a strong case or weak case then they would determine if they would approve the case or not later on. Anyway, they have nothing to lose to deny in the initial response. I would suggest everyone at least contest with a letter to keep the dispute ongoing. In another word, they won’t be able to get away from this so easily. My question to whomever here knows legal things better than I do is “Is there anyway we (all the victims who have financial loss due to this GM engine defect) could hold this law firm accountable to reimburse the loss rather than benefiting themselves from legal perspective?” Personally I feel what they do is kind of fraud so we might have to sue them? Or write a formal letter to GM?

      Reply
      1. When I received the letter and it said you don’t need a lawyer I got a lawyer. I sent in all the proof and made copies of what I sent in. My lawyer said the same thing about contesting so we are sending in the letter from the mechanic explaining that it was in fact because of the oil consumption. If they deny again we will start with a formal letter to GM and then from there make our own law suit to GM about my car. And GM can end up filing a suit against the firm that did the class action for not paying out.

  149. I have a 2014 Equinox so mine car supposedly doesn’t qualify for this lawsuit. But about 3 years ago I was left stranded when my dash board lite up like a Christmas tree because the car burnt through almost all of the 5 qts of oil in less that 6,000 miles. After taking my car to the dealership for repair I then had to take my car in every 1,000-2,000 miles to prove it was burning oil. Finally the warranty would cover the replacement of the pistons. Now 3 years later my car is yet again burning oil to the point of engine issues. On top of the oil issues, around the same time I had to have the pistons replaced they had to repair a cracked in the exhaust manifold, I had the work done at a GM dealership hoping that would ensure it was done correctly. Just over 1 year after repair the crack was back but my car was now out of warranty and the repair work out of warranty. When I called the dealership all I got was sorry nothing we can do. I’ve been living with the crack now for 2 years and it is to a point again I can’t sit at a stop light without rolling down the windows to stay safe. It’s winter and I live in Michigan, it’s getting little cold to do that. As a single mom or 2 it’s what I have to do to keep them safe until I can dump the POS car. I grew up with GM cars but I really considering buying from someone else after this car and the service I have received on it.

The thing you have to know that if this gets fixed, the dealership gets paid from GM just as if you were paying out of pocket, so they should help you out.

I made an appointment with a gm dealer to have the oil test performed over the next 3 or 4 weeks. Car failed miserably. Used 2 quarts every 1000 miles. The dealership filled the claim for us and was approved. They clearly stated it was due to piston ring failure. They did try to say at first it was not burning oil but I was present every time it went in to get checked and recorded video of the mechanic performing the test. Proof it was using oil. They couldnt argue their own certified technician stating it was the rings….. Document everything. Have a gm dealer run the test. Cost what a normal oil change would. They wasted no time rebuilding the entire engine free of charge.

  156. My wife has a 2012 GMC Terrain, same engine, doing the same thing, oil consumption very poor. Get this, it only has 38,000 miles on it. Yes that is correct 38,000 miles. She drives so little that I changed the oil based on time and not mileage. Every 6 months it was changed, Mobil 1 5w-30, and a new filter. Just recently she has been driving a little more, so I checked the oil after the last change (576 miles driven) and it was down 1 full quart. I added and monitored the oil level. Now around every 600 miles I am putting a quart of oil in this oil sucker. I called the dealership and have an appointment to bring the car back, but I am now reading everything I can to be prepared to deal with this. I believe in going in armed for bear even if hunting squirrels. I will keep everyone posted on how we make out.

  157. After turning in all the paperwork that GM asked for it took almost a year to hear back. Of course they informed me that my claim had been denied. I had a 2010 Equinox with only 50 thousand miles on it when I started having problems. I had to pay for the initial repairs at a cost of about $1600. After the repairs it was still giving me problems and I went through the oil consumption tests. The initial test indicated it used up all the oil in less than 4 thousand miles. That was when I had the problem. After the repairs the next oil consumption test showed my car used over a quart of oil in less than 1,000 miles.
The next test showed that it had used almost 2 quarts in 1,000 miles. While going through the third oil consumption test my car was broadsided and eventually totaled. I just received a letter saying my claim was denied and if I wanted to object I had only 10 days to respond. I currently have 3 Chevrolets including a 1996 Corvette and being from Flint, Mi I have always bought GM cars. If they don’t do something about this obvious problem I will not buy GM cars again.

  160. Joined CA Lawsuit from the very beginning. Was sent denial letter from GM. So, I wrote a rather lengthy letter to the CEO of GM, the Judge that ruled on the case, local news stations copying everyone on the reasons why my case should not get denied. I included CarFax report showing all oil changes, listed every single conversation I had with GM customer service and the dates. (I saved all voice mails so I knew exactly when I spoke to them) Sent all letters certified. Heard back from Executive offices at GM asking me to call them. I was done talking to people and being told there was nothing they could do, so I did not call back. Judge actually copied numerous people after receiving my letter. Low and behold……a check arrived for the full replacement amount of my engine several weeks later. Best of Luck. I put some time in to get all the information accurate in the letters, but it paid off. Sad that GM just denied majority of the claims and made everyone jump through hoops to get reimbursed/reconsidered. Keep Fighting!

  161. Shame on the Judge for approving the narrow terms set forth in this settlement. Total BS. The only winners here are the lawyers!
Any internal engine component damage failure is directly due to the Ecotec engine oil consumption issue, PERIOD!
My 2011 Equinox ate oil so bad, I could not get a reading on the oil dipstick prior to a vacation road trip! Was never given any dashboard low engine oil alert. GM did the mandatory 1000K mile oil consumption test to confirm the problem. They did the new piston/ring replacement, but never replaced the compromised cam phasers which failed on a subsequent vacation trip, costing me $700.00 to replace. I was denied the $700.00 reimbursement by Analytics LLC, claiming failed cam phasers were not related to oil consumption issue. Cam phaser rely on full oil levels to maintain proper oil pressure in order to work properly and not prematurely fail.
I appealed their decision and now are waiting for a response. It was supposed to be within 45 days from the time Analytics LLC received my appeal. Well past that 45 day window now.
I had read where this claims review board were mainly GM personnel. If so, we are all screwed.
Once again, shame on the judge for allowing the BS settlement terms.

In the original paperwork, we were asked to send receipts for repair work caused by the defect. Why are none of those claims being approved? Isn’t there anything we can do to appeal these decisions??? This is not fair in any way, shape or form. This is disgusting and GM should be put on notice by anyone who has legal authority. Obviously none of the people we are trying to get in contact with drive an affected vehicle or they would be right along side us protesting. Ugh

    1. Yes I have a 2011 Chevy equinox that’s having use of engine . Take it too the dealership and they wouldn’t fix the problem. Told me I would have to pay for the service. Called GM and they wasnt a help. Still paying on the vehicle and having so many problems.

    2. Kristina, that would be awesome. I sent our receipt in for our GMC Terrain as soon as it was requested for the class action lawsuit. When I followed up last November, I received a response through email that we were denied due to the year of vehicle, it is a 2012, but never a letter in the mail to dispute it, as promised. I never followed up because everyone in the Facebook group and on here was being denied. I’m to the point I’d like to join forces with all to take this further now. What is your email address so we can reach out?

      Reply
      1. Actually, here is what the email said: I just reviewed the response from Analytics. Your model vehicle was a 2012, which has time and mileage limits under the settlement agreement of seven years, six months or 120,000 miles, whichever comes first.

It appears your vehicle was delivered on November 19, 2011. Therefore, under the settlement, the time for repairs expired either on or around May 2018 or at 120,000 miles, whichever came first.

It appears your vehicle was repaired on November 26, 2019, which is beyond the May 2018 time limit expiration under the settlement agreement. Therefore, you will be receiving a rejection letter. If you believe any of this information is inaccurate, then you will have ten days from the date you receive the rejection letter to submit a dispute to Analytics.
        Thank you,

    4. My bill was denied because it didn’t state that the oil consumption was due to worn piston rings. I have a 2013 Terrain and the engine went at about 70000 miles. The bill states that the problem was excessive oil consumption and the pistons and rings were replaced. Sounds like everyone is being denied.

  166. Kristina,

Submitted my claim for 2.4L Ecotec for bad cam phaser replacement due to oil consumption issue in February 2020 on my 2011 Chevy Equinox. Analytics LLC denied claim in November 2020 for $628 repair bill, stating failed cam phasers were not related to oil consumption issue. BS!!!!!!!!!
I had 10 days from receipt of denial letter to contest their denial with supporting documentation. I did, mailed out November 23 with rebuttal and supporting documentation. The Ecotec 2.4L cam phasers can only work properly when the oil level is at the correct level. The cam phasers rely on oil pressure to perform correctly. Low oil will cause them not only not to perform correctly, but also cause them to prematurely wear out and fail.
The denial letter also stated they would respond within 45 days of my initial denial letter re-submission. It is now well past the 45 calendar and working day window, and still have not heard back from them.
Using covid as an excuse will not fly with me in delaying their response.
I have to wonder if everyone who has had their initial claim denied could sue Analytics and/or GM in their local small claims court on the premise that initial claims are being denied that meet the eligible reinbursement criteria set forth in this Burman settlement language. If that is possible, that would make for a much, much more costly litigation for them!
Might be worth asking your lawyer if possible!

p.s. I had read somewhere where the Analytics LLC folks ruling on these claims are closely tied to GM.

  167. Kristina, my first initial letter was denied. I filed my detailed letter within the 10 business days deadline. As of right now I haven’t received anything. I submitted all my receipts with explications.

  168. Thank You Kristina,
My case was direct with GM. My daughter’s car engine seized and I called the law firm the Monday after their obligation ended. They told me to contact GM directly.
Gm told me I had to have the oil consumption test performed or they could not do anything. Well the engine seized. That test could not be performed. So GM made another $10,000 off of a car listed in the settlement. And the mileage was under 100,000 which is less than the new extended warranty also.
Thank you for doing this as there is no policing for class action suits to make sure these companies comply with their court order.

  169. Kristina/All,

Just fired off below email to Rachel Soffin, Berman Law Group, and Judge Rosenberg Court Clerk (hope it gets us all proper financial relief for our out of pocket expenses!):

    Rachel/Berman,

I’m sure by now you are well aware of the overwhelming majority of initial claim denials by Analytics LLC with respect to the Berman v GM Ecotec 2.4L Litigation Class Action Lawsuit, as well as subsequent class action plaintiffs appeal denials also.
Not sure who’s responsibility it is to ensure that Analytics LLC accurately adjudicate all claims within the terms and language set forth by the lawsuit settlement terms.
The Analytics LLC “canned” denial letter states all other non oil piston ring related engine problems are not due to the faulty piston rings.
One does not have to be a Subject Matter Expert to realize that low oil and low oil pressure will cause many internal engine components to fail, and that these failures ARE directly related to the faulty piston rings!!

Page 10 of the Final Settlement Agreement clearly states:

“In light of the minimal expected recovery, the Settlement offers substantial benefits to Class Members. The Settlement provides two primary forms of consideration. First, it provides new notice of the 2010–2012 SCAs, extends coverage for rental car expenses, and extends the deadline for out-of-pocket claims. The new notice clarifies the scope of covered repairs and expenses: in addition to rental car expenses, the settlement includes any necessary repairs for engine damage caused by the oil consumption defect, not solely piston replacement.”

In my case, the 2011 Chevrolet Equinox engine cam phasers failed and needed replacement at my expense of $625.28 while vacationing out of town. My out of pocket expenses also include additional hotel lodging.
I appealed my initial Analytics LLC denial letter within the 10 day response time window on 11/23/2020. The denial letter states that Analytics LLC will respond to the appeal within 45 days. We are now well past the both 45 calendar and working day window, and still have not heard back from them!!

I have supplied a mountain of supporting documentation as absolute evidence that the low oil pressure caused the cam phasers to not perform properly, as well as fail prematurely. The cam phasers need full oil levels as they rely on oil pressure to work properly. Never once did I ever get a low oil pressure warning light on my instrumentation car panel!

Please let me know who is responsible for ensuring Analytics LLC properly evaluate all claims within the terms of the final court settlement and/or any other legal action I can take. I am not going to let both Analytics LLC and GM get a pass on this. If you and the other law firms are responsible for ensuring all the claims are properly evaluated, please take note and act accordingly.
Let Judge Rosenberg know that the lawsuit settlement terms are not being honored by Analytics LLC.

  170. I received a check in the mail last week. Total I claimed was $1,095 and how much did they send me?

    $140

It’s shut up money is what it is.

I was lucky, a lot of my issues were covered by dealer warranty. My OOP costs were from 2 repair charges, a rental and a tow (the only tow I could find the receipt for). I thought what I was asking for was more than fair. I had my 2011 Equinox less than 5 years and it had to have the engine completely rebuilt not once, but 3 TIMES. Each time the engine failed, I was driving. Once I was on the freeway when the thing just went into limp mode. The other times I had people in the car with me and once we were stranded in a bad area. The repairs were all done at the dealer. I submitted every stitch of paper I received, taking care to highlight notes and dates. The mechanic typed all the buzzwords (about excessive oil consumption due to piston rings, etc, etc) on my invoices and they still wouldn’t give me my full claim. I honestly don’t know what they’re looking for. I feel like they’re just systematically denying or shorting the reimbursements for everyone

Considering what owning that vehicle has cost me – my time, my safety and the safety of those with me, the payments I still had to make on it while it sat in the shop for weeks at a time, the work I missed schlepping to and from dealerships, i could go on – I think what I asked for was more than fair.

I also think it’s pretty telling that they basically admitted what they sent was a pittance, Oh but if I submit the exact same stuff I sent earlier last year with a letter, maybe they’ll change their minds and decide I’m worth more? I’ve only been part of a few class actions but each time, my experience was “We won X amount, here’s your portion”. Not “We won X amount. We’re not giving you your full portion though. We’ll give you an amount that we know and admit is well below what you asked for and what we said we’d give. We might give you the rest, but you’re going to have to work for it.” Of course I’m contesting what they sent. I pay for legal services thru my job and I will have someone take a look at my letter. And I, along with my family, will never, ever buy another GM product as long as I draw breath.

Good luck to everyone else out there dealing with this. Sounds like we’re all in the same boat.

  172. Kristina,

Where do you stand with your lawyer reaching out to Judge Rosenberg? I received my appeal letter from Analytics today denying my claim for reimbursement of failed cam phasers. Analytics did not specifically detail why my claim was denied, just another “canned” denial response letter!
I believe the vast majority are being denied legitimate claims reimbursements. I am no lawyer, but have to think this is a violation of the the court settlement order!
As others have stated, I will never buy another GM product. I purchased an import and pushing 90K miles w/o a single issue!
Please reply with your status to the court.

  175. For those of us who sent in additional reimbursement receipts, I thought that was extra money that would be owed to the consumer. In other class action settlements, I’ve received money based on the settlement alone and with this one they asked for additional claim reimbursement, which is what the majority of us have done, to no avail. DENIED, DENIED, DENIED! Will we eventually receive money for the initial settlement since all of us have been denied any money for the receipts we sent in? This is so unethical from all involved, the court, GM and the administrator.

    1. Missy,
If you read the Settlement only “Class Representatives” (11 in total) were guaranteed a cash settlement ($4500). They call it a ‘service payment’. This money was specifically set aside for them. No other monetary amount for all other members of the suit is discussed, defined nor guaranteed in the final settlement. I am still fighting my denial as well.

      VI. SERVICE AWARDS
The Court grants Class Representatives Ellen Berman, Patrick Sanchez, Mark Stauber and
Sally Stauber, Jacob Ross-Demmin, Jennifer Herrington, Ryan Hindsman, Robin Peterson, Diana
Miranda, Vanessa Maryanski, Rene Mitchell, and Brittany Chambers a service payment of
$4,500.00 each for his or her services as Class Representative. Although Berman is the only Class
Representative named as a Plaintiff in this action, this Settlement resolves all Related Actions and
was achieved through the efforts of Class Representatives across all Related Actions. The Court
finds the service payment of $4,500.00 for each Class Representative to be appropriate, fair, and
reasonable. This amount is being paid by Defendant General Motors separately from the funds
made available to Class Members pursuant to the Settlement Agreement.

  176. Thank you David for clarifying that bit of information. I was also denied twice and that is why I’m confused. Why are we even included if nothing is going out to all of the consumers who purchased and have issues with their vehicles. It seems so pointless for us and in fact it infuriates me but it is what it is and I as well will never purchase a GM or Chevy vehicle.

    Reply
    1. Unfortunately, they want us included because we give up the right to be in further litigation by not opting out of this suit.

  181. Originally, I received notification regarding the lawsuit but haven’t received anything else. I spent the time requesting receipts from various service departments for my major repairs on my 2011 Chevy Equinox.

I replaced one engine and was told I needed to replace another. But when the air conditioning went out it would very costly to repair both.

  182. I wonder if we all started contacting local TV stations to get the word out about how we have been treated, if that would make a difference? It seems there is a common thread here, no payment. I know there are going to be some cases among us that may have been denied, but most of us on here is saying that they have not received ANY money or very little of their claim. I say let’s get the word out.

  183. I just started having issues with my 2012 GMC terrain oil consumption at 85,000 miles. I came to the dealership where i bought it and was told that it was a special warranty but it expired in 2020. I never received anything that i know of alerting me of this issue. Very dissappointing. I will be in the market for a new vehicle in the next few months, will not be looking at GM. What ever happened to good customer service and reliable products. Its not like these vehicles were free.

  184. As with ALL modern engines that now come with the water thin 0W-20, they burn oil and have early bearing failures.

    The cure is simple.

Just switch to 0W-30 from day ONE and the oil burning and bearing damage can be avoided.

These CAFE oils combined with the weak piston rings all new engines now use results in all the problems people report later on.

Toyota, Honda, Subaru, Audi, and on and on have been sued over these same issues and more law suits will be coming.

But while some admit their mistakes and replace engines under warranty, others merely lie and deny and tell customers it’s “normal” for your car to sound like an old beater with 300,000 miles on it a burn a quart of oil every 1,000 miles.

Too small of an engine for too big of a vehicle and that’s just the start of problems with this engine. Looking into this lawsuit. We bought this car used for $8800 and still owe $4200 on it! We’ve had it literally 3-4 months! It’s my sons. His senior year in high school. He’s in a work program needing it to leave school in the mornings so taking the bus isn’t an option. Do better Chevy!

  189. We have the same problem. What your problem is, that the air cleaner needs to be taken off because its creating a lot of condensation in it. Then, if you live in a cold climate, what happens, is it freezes, builds up compression and blows the seal. If you drill a hole in the bottom of the air cleaner, under the PCV hose, and change the seals, it won’t happen again. Bad flaw. Good thing I have awesome friends. I’m watching them do it now.
