General Motors Ignition Switch Fund Reaches 100 Approved Claims For Injury Or Death

In administering General Motors’ ignition switch recall, attorney Kenneth Feinberg created a fund to handle all submissions and claims. As of this past Monday, the current status of approved claims for injury or death was 100, with seven new injury claims and four new wrongful death claims bringing the current total number of injuries to 58 and amount of fatalities to 42.

To date, 2,326 claims have been filed. Of these, 306 have been rejected, 568 have been declared deficient, and 907 did not include verifying information. Currently, 445 claims are under review, of which 46 are for wrongful death.

Among the 100 claimants whose applications have been approved, 57 have received settlement offers, none of which have been rejected. Of the 57, 22 have been paid. GM has said that it estimates the payout to reach $400 million.

Those who own one of the affected vehicles and have been in an accident due to a faulty ignition switch have until January 31, 2015, to submit a claim.

  2. You know , this thing is feeding on itself . The more they settle , the more supposed valid or opportunistic claims surface . The worst driving accidents that claim lives in North America are not in any particular order , but include ; DUI , a horrific statistic , not only for drivers and passengers but for pedestrians , as well . Unbelievably , those who still don’t wear seat belts , people who drive when tired or distracted and drift into oncoming traffic or off the road .Those who drive too fast in foggy conditions or on snow/icy roads which can cause multi car pileups and often deaths . All this is , if not forgiven is worse yet an accepted hazard of owning and driving vehicles , of course , eased by the insurance we are obliged to carry .

One of the most unfathomable errors owners make and is not a crime is “not answering and responding to RECALLS “. Recalls are issued normally when there are driveability issues that can cause serious problems and yet many owners find excuses not to respond . One Ford problem , I think it was , had the recall so poorly responsed to , it was followed up by a TSB(technical service bulletin) . The federal gov.apparently took them to court . Ford did what it was supposed to do but settled out of court to avoid a large legal expense to fight it . If the delinquent recall owners were involved in serious accidents l , how do you think this would have played out in a class action suite ? ie , well your Honor , I was sick , never received the letter , out of the country the past 6 months , can’t afford to drive 30 miles to a dealership etc , etc

This , folks , is the total lack of responsibility by owners and it isn’t a concrete chargeable offense . There has to be a balance here as in life . Owning and operating a vehicle is a privilege not a right ! This privilege is granted by the government if the applicant studies THE DRIVER HANDBOOK and writes a written test followed by a driving test . It is encumbent on the owners to operate the vehicles within the law , at all times . But where is the penalty for failing to properly maintain the vehicle , and how would the authorities undertake to analyze a mangled wreck to determine if the owner so failed to maintain . The countless wrecks that cause mayhem and death would be a nightmare cost in forensic and mechanical analysis costs to scientifically prove 100% that the owner didn’t adequetely maintain his vehicle . Yet , often it seems owners/people in general , now , will jump at the chance to prove someone else , instead , is responsible for their mistakes . Do manufacturers make mistakes , yes , but look at all the horrid deaths and life altering injuries and tell me that human lack of accepting responsibility for their actions hasn’t caused the bulk of human suffering and deaths here !!
